Booking Policy :

A final number of guests is needed 2 days prior to scheduled departure date. Any change to the number of guest should be notified to Xperience Thai that will confirm or not the trip and the amount of fees.

Cancellation and No Show Charges Policy:
If the trip is cancelled less than 48 hours before the departure date, the entire amount of the charter cost will be charged.
If the trip is cancelled more than 48 hours before the departure date, the 30% booking deposit will not be refunded.
Trip length: The duration of our trip depends on a number of factors including weather and sea conditions and can be modified accordingly.
Alterations of itineraries: Xperience Thai reserves the right to alter cruise itineraries due to weather conditions or other circumstances.
Weather and sea conditions: We reserve the right to cancel the boat trip without notice. This can be due to a variety of reasons, including but not limited to, changing weather and sea conditions or technical reasons. However if it is necessary to cancel a boat trip for any reason an alternative date or a full refund will be offered. We will advise passengers of any cancellations prior to the day of departure.
Safety: Please act responsibly on the boat and follow our safety procedures and follow the safety guidelines. All passengers must follow instructions provided by the crew. Passengers must exercise due care and attention to avoid slips or falls when moving around the vessel. Passengers must not behave in a way that may offend or disturb the comfort or safety of other passengers or crew. Failure to comply with any reasonable instructions may result in any offending passengers being taken back to shore. We cannot be held accountable for any actions where due caution and restraint has not been followed.
Child safety: Children must be under parent/guardian supervision at all times.
Insurance: Xperience Thai maintains marine insurance meeting all statutory requirements, however we strongly recommend that passengers hold comprehensive and suitable travel, medical and cancellation insurance.
Clothing/belongings: Sea conditions may result in passengers getting wet and or cold. Suitable clothing should be worn and passengers should be prepared for changing conditions whilst at sea. Waterproof bags for camera equipment are also advisable. Any belongings brought on to the boat are the responsibility of the passenger and we cannot be held accountable for any breakages or lost/stolen items.
Mobility: A reasonable level of fitness and agility is required. The trip requires being physically able to walk on the gangways of the boat and to take the steps.
Dogs: Dogs are not permitted on the boat.
Departure time: If you do not choose our pick up service, it is advisable to arrive and check in at least 30 minutes prior to the departure time.
WAIVER AND RELEASE OF LIABILITY

You acknowledge that some, but not all of the risks of participating in boating and watersport activities include: 1) Changing water flow, tides, currents and wave action;
2) Collisions with any of the following: other participants, the boat, other boat, and manmade or natural objects; 3) Collision, capsizing, sinking or other hazard which results in wetness, injury, expose to the elements, hypothermia, drowning, etc..;
4) attack by or encounter with insects and marine life forms, including, but not limited to sharks and/or sting rays and/or jellyfish; 5) Heat or sun related injuries or illnesses, including sunburn, sunstroke or dehydration. The description of these risks is not complete and unknown or unanticipated risks may occur and result in injury or illness.

The undersign hereby agrees that he/she is renting, operating or using the equipment provided by Xperience Thai at his/her own risk. The undersigned agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental equipment, The undersigned assumes full responsibility for any damage or destruction of the equipment and for the risks of personal injury, accidents or illness and any resulting expenses from any of the foregoing risks and assumes all risk injury, illness, damage or loss that might result, regardless of the cause. The undersigned hereby agrees that he/she will indemnify and hold harmless for all personal injuries, property damages, or any other damages to any and all third parties as a result of any and all activities related to the rental, operation, or use of equipment provided by Xperience Thai.

By executing this document, the undersigned voluntarily releases, discharges and agrees to indemnify and hold harmless Xperience Thai from any and all liability of any nature for any and all injury or damage arising from personal injuries sustained by the undersigned or any minor children under the undersigned’s custody, care, and control, as a result of any and all activities during the boat trip including the operation, or use of equipment provided by Xperience Thai regardless of the cause. The undersigned assumes full responsibility for any such injuries or damages, which may occur, and further agrees that Xperience Thai shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that Xperience Thai shall not be responsible for such injuries, damages or loss.

ACKNOWLEDGEMENT OF WAIVER AND RELEASE – The undersigned states that he/she has had sufficient time to review the Waiver and Release and to ask any questions associated with such release. The undersigned further states that he/she has carefully read the foregoing Waiver and Release, knows the contents thereof, and has signed this Release as his/her own free act.

The undersigned further warrants that he/she is fully aware that he/she is waiving any right he/she may have to bring a legal action to assert a claim against Xperience Thai.
